PAYMENT POLICY
- All payments are due on the date that appears on your contract.
- Default occurs whenever your payment is not postmarked within 5 business days of the due date.
- When default occurs, West 50 Storage may remove your gate access code and/or place a lock on your locker.
- Once default occurs, West 50 Storage will send you a “Default Letter” by 1st Class Mail to your last known address. By law, a minimum of 45 days must pass from the date of this letter before a locker’s contents may be sold to satisfy the amount in arrears and/or until the vehicle may be towed.
- If no payment is received within ten days after mailing the Default Letter, a second “Second Default Letter” will be sent by registered or certified mail to your last known address containing:
- Notification that your stored property is subject to an Operator’s Lien;
- The amount currently due, any additional amounts that will be due prior to property sale, and the date the additional charges are due.
- Demand for payment by a specific date, not less than 10 days after the date the Second Default Letter was mailed;
- A statement that unless the claim is paid within the time stated, the contents of the your rented space will be sold after a specific time;
- Our name, address, and telephone number so that you know who to contact to respond to the Second Default Letter
- At least 7 days prior to the property sale, a classified ad will be placed in a local newspaper specifying the locker number, date, time, and that the contents will be released for sale.
- At any time before a property sale, you may pay the amount necessary to satisfy the lien and redeem the your personal property.
- If the property is sold for more than what is due, the excess must be held for one year and be paid to you upon demand. The payment can only be made after you file a sworn affidavit with West 50 Storage stating that there are no other valid liens against the property sold and indemnifying West 50 Storage for any damages incurred or monies paid by West 50 Storage due to claims arising from other lienholders of the property sold. After one year, the excess must be paid to the State Treasurer.
